To use the Services provided by Lytehosting.com, you must agree to and comply with these Terms of Service. By accessing or using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of an organization or entity, you represent and warrant that you have the authority to bind such organization or entity to these Terms of Service.

In order to use certain features of the Services, you must register for a Lytehosting.com account ("Account"). When you create an Account, you agree to (a) provide accurate, current and complete information as may be prompted by the Account registration form ("Registration Data"); (b) maintain the security of your password; (c) maintain and promptly update the Registration Data, and any other information you provide to Lytehosting.com, to keep it accurate, current and complete; and (d) be fully responsible for all use of your Account and for any actions that take place using your Account.

All prices and fees are non-refundable once the Services have been initiated by the User's activation of User's Lytehosting.com account regardless of whether the Services are subsequently suspended, terminated, or transferred prior to the end of the expiration of the domain name registration provided that such suspension, termination or transfer is not caused by the gross negligence of Lytehosting.com.

You are responsible for all activity that occurs under your Account, including but not limited to any unauthorized use of your Account. You agree to immediately notify Lytehosting.com of any unauthorized use of your Account or any other breach of security. Lytehosting.com will not be liable for any losses caused by any unauthorized use of your Account. You agree to accept responsibility for all activities that occur under your account or password.

Lytehosting.com will keep all information submitted by you confidential and in accordance with our Privacy Policy. By using the Services, you agree to the collection, use and sharing of your information as set forth in our Privacy Policy.

If a user account does not have any active products and has no associated invoices for a continuous period of six (6) months, the account will be marked as inactive and may be permanently deleted, including all associated data.

If an account contains only expired or terminated services and remains unused for a continuous period of two (2) years, Lytehosting.com reserves the right to permanently delete the account and all related records.

Once deleted under this Inactive Accounts Policy, the account and its data cannot be recovered under any circumstances.

We may attempt to send notice via the registered email address before deletion occurs. However, delivery of such notices is not guaranteed, and deletion may proceed regardless of notice receipt.

When a hosting service expires, it may enter a temporary suspension (grace) period during which the User may still renew the service and restore normal operation. This suspension period is time-limited and does not extend indefinitely.

If the service is not renewed within the applicable suspension period, the service will be terminated. Termination is a final state for the service.

For Shared Hosting and Corporate Hosting / Managed VPS plans, terminated services may have data available for restoration from backups under the following terms:

• Data restoration for Shared Hosting: USD $150
• Data restoration for Corporate Hosting and Managed VPS: USD $250
• Restoration is only available for services terminated after the 30-day grace period and within 180 days from termination

Unmanaged VPS and Dedicated Server plans will not have any data available after termination. Users acknowledge that it is their responsibility to maintain independent backups of their data at all times.

LyteHosting shall not be held liable for any data loss resulting from the User's failure to renew services prior to termination.

• Fraud Verification: Lytehosting LLC reserves the right to verify customer identity and billing information. Orders suspected of fraud or identity theft may be delayed, suspended, or canceled without notice.
• Chargeback Abuse: Initiating a chargeback or payment dispute without first contacting our billing department constitutes a breach of this agreement and will result in immediate account termination. Customers remain liable for all legitimate charges and associated recovery costs.

Refunds will only be considered if: (a) Service was not delivered as described on our Website; (b) Service was not delivered within the estimated delivery time; (c) Service was not delivered in accordance with our Service Level Agreement.

You must first raise a support ticket to report issues. If the issue cannot be resolved, you may request a refund within 7 days from the date of purchase.

Due to the nature of virtual private servers (VPS) and dedicated servers, all sales are final once the service has been provisioned. VPS and dedicated server plans are non-refundable under any circumstances, including but not limited to cases where: IP addresses/resources have already been assigned; Third-party software licenses (cPanel, LiteSpeed, Plesk, DirectAdmin, etc.) have been activated; or Misunderstandings regarding included features.

The following services are not eligible for a refund: Domain name registrations and renewals, VPN services, SEO services, Social media management services, SSL certificates, and Email services.

To request a refund, raise a support ticket. If the issue cannot be resolved, request the refund within 7 days of purchase by replying to that ticket. Eligible refunds are processed within 14 business days to the original payment method or LyteHosting Wallet.

The following conduct is prohibited and may result in termination:

• Engaging in illegal activity or distributing material that is obscene, defamatory, threatening, abusive, harassing, or fraudulent.
• Sending unsolicited email (SPAM) or advertising material to individuals who did not request it.
• Attempting to interfere with, disrupt, or disable service through viruses, flooding, spamming, or mail-bombing.
• Accessing non-public areas of the Services or testing system vulnerabilities without authorization.
• Impersonating or falsely claiming to represent a person or entity.
• Reselling the Services or hosting content for third parties without express written consent.
• Hosting adult content, including materials of a sexually explicit nature, or any child sexual abuse material (CSAM), child sexual exploitation content, or any content involving the sexual exploitation or abuse of minors.
• Engaging in activity that consumes excessive bandwidth or threatens system stability.

Users are strictly prohibited from using LyteHosting LLC services for activities including but not limited to:

• Financial fraud, investment scams, or Ponzi schemes.
• Identity theft, phishing, social engineering, or credential harvesting.
• Fake online stores, counterfeit goods sales, or merchant fraud.
• Romance scams, dating fraud, or relationship deception for financial gain.
• Cryptocurrency scams, fake ICOs, or blockchain fraud.
• Employment scams, lottery scams, or advance fee fraud.
• Academic fraud, insurance fraud, tax preparation fraud, or charity fraud.
• Tech support scams, real estate fraud, or pyramid schemes.

All users must comply with applicable laws. LyteHosting LLC reserves the right to immediately suspend or terminate services without notice upon receipt of complaints, discovery of illegal content, law enforcement requests, or reports from financial institutions. No refunds or compensation will be provided for suspensions related to illegal conduct.

LyteHosting LLC will fully cooperate with law enforcement, including providing account information and preserving evidence. Users agree to indemnify and hold harmless LyteHosting LLC from any claims, damages, or legal actions arising from the User's fraudulent or illegal activities.

LyteHosting LLC reserves the right to flag any account exhibiting suspicious, abusive, or potentially illegal activity. Accounts may be flagged based on internal monitoring, user reports, or other reasonable indicators of misuse.

Upon flagging, the account holder will be notified and requested to provide legal documentation or other verification within 7 working days to validate the account's activities. Failure to provide such documentation within the specified period may result in suspension or termination of the account.

Accounts terminated under this process are not eligible for refunds, and no backup of data will be provided. LyteHosting LLC may share relevant information with authorities or affected parties as required by law or to prevent further abuse.

You agree that LyteHosting, in its sole discretion and without liability to you, may refuse to accept the registration of any domain name. LyteHosting also may in its sole discretion and without liability to you delete the registration of any domain name during the first thirty (30) days after registration has taken place. LyteHosting may also cancel the registration of a domain name, after thirty (30) days, if that name is being used, as determined by LyteHosting in its sole discretion, in association with spam or morally objectionable activities. Morally objectionable activities will include, but not be limited to: (i) activities prohibited by the laws of the United States and/or foreign territories in which you conduct business; (ii) activities designed to encourage unlawful behavior by others, such as hate crimes, terrorism and child pornography; and (iii) activities designed to harm minors or unethically use or exploit minors in any way. In the event LyteHosting refuses a registration or deletes an existing registration during the first thirty (30) days after registration, you will receive a refund of any fees paid to LyteHosting in connection with the registration either being cancelled or refused. In the event LyteHosting deletes the registration of a domain name being used in association with spam or morally objectionable activities, no refund will be issued.

You agree that your failure to comply completely with the terms and conditions of this Agreement and any LyteHosting rule or policy may be considered by LyteHosting to be a material breach of this Agreement and LyteHosting may provide you with notice of such breach either in writing or electronically (i.e. email). In the event you do not provide LyteHosting with material evidence that you have not breached your obligations to LyteHosting within ten (10) business days, LyteHosting may terminate its relationship with you and take any remedial action available to LyteHosting under the applicable laws. Such remedial action may be implemented without notice to you and may include, but is not limited to, cancelling the registration of any of your domain names and discontinuing any services provided by LyteHosting to you. No fees will be refunded to you should your Services be cancelled or terminated because of a breach. LyteHosting's failure to act upon or notify you of any event, which may constitute a breach, shall not relieve you from or excuse you of the fact that you have committed a breach. LyteHosting is required to notify ICANN within seven (7) days of bankruptcy, certain convictions, and security breaches involving registrant account information or registration data.

You agree not to use the services provided by LyteHosting, or to allow or enable others, to use the services provided by LyteHosting for the purposes of: (i) the transmission of unsolicited email (Spam); and/or (ii) repetitive, high volume inquiries into any of the services provided by LyteHosting (i.e. domain name availability, etc.). You acknowledge and agree that you are prohibited from distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law, and you acknowledge and agree that the consequences for such activities include, but is not limited to, suspension of the domain name. If you are hosting your domain name system ("DNS") on LyteHosting's servers, or are using our systems to forward a domain name, URL, or otherwise to a system or site hosted elsewhere, or if you have your domain name registered with LyteHosting, you are responsible for ensuring there is no excessive overloading on LyteHosting's servers. You may not use LyteHosting's servers and your domain name as a source, intermediary, reply to address, or destination address for mail bombs, Internet packet flooding, packet corruption, or other abusive attack. Server hacking or other perpetration of security breaches is prohibited. You agree that LyteHosting reserves the right to deactivate your domain name from its DNS if LyteHosting deems it is the recipient of activities caused by your site that threaten the stability of its network.
